Constructive Eviction

A constructive eviction occurs when the property you are renting is uninhabitable. This means that the property is not suitable to live in. This creates a situation of constructive eviction. In order to claim a constructive eviction, as a tenant, you are required to serve the landlord with written notice of the constructive eviction and give the landlord a reasonable amount of time to correct the problem(s).

If your landlord does not correct the problem(s) within a reasonable time, you may be able to leave the property and not be responsible for paying the rent due. As a tenant, you will have to physically vacate the premises and sue for damages, termination of your lease agreement, etc.
